Customer License Agreement
After the completion of your payment transaction to Josh Lockhart, Josh Lockhart grants you ("Customer") a Commercial License for each purchased product ("Licensed Material"). Your payment for the Licensed Material is considered your acknowledgment and acceptance of the following terms.
What you CAN DO
- You have the non-exclusive, non-transferable, non-sublicensable right to use the Licensed Material in accordance with this Agreement;
- You may use the Licensed Material an unlimited number of times for personal or non-profit purposes (ie. any purpose that does not make money);
- You may use the Licensed Material one time for commercial purposes (ie. any purpose that makes money); you must purchase a separate license for each product for each commercial purpose;
- The Licensed Material may only be used in conjunction with RapidWeaver, a Mac OS X application developed and sold by Realmac Software;
- You may not use the Licensed Material for any other purposes without written permission from Josh Lockhart.
What you CAN NOT DO
- The Licensed Material is not being sold; it is being provided to you under the terms of this Agreement which allows for the use of the Licensed Material but does not transfer ownership;
- Ownership remains with Josh Lockhart;
- You may not rent, sublicense, sell, assign, convey or transfer Licensed Material, this Agreement or any of the rights under this Agreement;
- You may not sell, license or redistribute the Licensed Material, or derivatives of the Licensed Material, in any format;
- Unauthorized use results in the immediate termination of this Agreement, and with it, your rights to use the Licensed Material.
Copyright and Ownership
No ownership or copyright in any Licensed Material shall pass to the Customer by the issuance of the license contained in this Agreement. Copyright and ownership of the Licensed Material remain with Josh Lockhart.
Governing Law
This Agreement and any sale hereunder will be goverened by the laws of the state of Wisconsin in the United States of America, without regard to conflicts of laws rules, regardless of the location of the Customer. Any dispute, action, or litigation must be brought in Wisconsin in the United States of America and Customer consents to the jurisdiction of the federal and state courts located in Wisconsin in the United States of America, submits to jurisdiction there, and waives the right to change venue. Customer hereby agrees that such venue is appropriate and that Josh Lockhart's agreement to sell and deliver the Licensed Material and/or services to the Customer is dependent on this provision.
